3. General Provisions
These Terms and Conditions, which also constitute regulations within the meaning of the Act on Electronic Services, define the rules for using the Store.
Customers can access these Terms and Conditions at any time via the Store’s website at www.snkrz.co and may download the Terms and Conditions as a PDF file and print it.
These Terms and Conditions specifically define:
- the rules for registering a Customer Account in the Store;
- the conditions and rules for placing Orders electronically in the Store;
- the rules for concluding Sales Agreements for Products using services provided within the Store.
The condition for using the Store is acceptance of these Terms and Conditions. Registering a Customer Account and placing an Order requires confirming acceptance of the provisions of these Terms and Conditions via a check-box function. Failure to accept the Terms and Conditions will prevent the Customer from placing an Order.
All Products offered in the Store are brand new, free from physical and legal defects, and have been legally introduced to the Polish market.
The Seller sells Products via the Store with delivery to the territory of the Republic of Poland. All Sales Agreements are concluded in Polish.
The recording, provision, and confirmation of essential provisions of the Sales Agreement to the Customer are carried out by sending the Customer an order specification and VAT invoice via the provided email address or another durable medium.
4. Rules of Using the Store
Customers can use the Store by registering and thus creating a Customer Account, where personal data and information about the Customer’s Orders placed in the Store are collected. The Customer has the right to terminate the agreement with the Seller concerning the Customer Account at any time by submitting a statement of intent to the Seller to delete the Customer Account. In this case, the Customer should contact the Seller.
The Customer is responsible for providing untrue personal data. The Seller reserves the right to refuse or cancel an Order if the Customer provided false data or if the data raises justified doubts regarding its accuracy. In such a case, the Customer will be informed by phone or email about the reasons for cancelling the Order. In such a situation, the Customer has the right to clarify all circumstances related to verifying the authenticity of the provided data and the cancellation of the Order. If there is no data allowing the Seller to contact the Customer, the Seller will provide explanations after the Customer initiates contact.
The Customer is responsible for all transactions executed using their login and password. The Seller undertakes to take all efforts to secure the login and password against disclosure. The Customer undertakes to take all measures to protect the login and password from unauthorized third parties.
The Seller is not responsible for providing the login or password to third parties by the Customer. In the event of expiration, change, or deletion of the email account provided by the Customer during registration, the Customer should inform the Seller.
The Customer declares that all data provided for the purpose of fulfilling the Order is true, while the Seller is not obliged to verify its accuracy and correctness.
5. Placing and Fulfilling Orders
The Seller allows the conclusion of a Sales Agreement by placing an Order by the Customer:
- Online, through the Store platform;
- By phone, via the Store’s helpline, as mentioned in §1(2) of these Terms, during working hours, excluding public holidays.
To conclude a Sales Agreement via the Store, the Customer must select Products by performing successive technical steps based on messages displayed on the Store’s website. Selection of Products is made by adding them to the Store’s shopping cart.
Until pressing the "Order and Pay" button, the Customer may modify the entered data, correct errors, and adjust the selected Products.
After entering all required data, a summary of the Order will be displayed, including:
- Subject of the Order (Product name, brand, size, color, quantity);
- Unit and total price of ordered Products, including delivery and additional costs (if any);
- Selected payment method;
- Method and delivery address of Products.
Sending the Order requires acceptance and confirmation of familiarity with the Store’s Terms and Conditions and pressing the "Order and Pay" button. Submitting the Order constitutes a declaration of intent to conclude a Sales Agreement with the Seller under the Terms and Conditions.
After placing an Order, the Customer receives an email confirming all essential elements of the Order. If some Products are unavailable, the Customer is informed about the status and decides how to proceed (partial fulfillment or cancellation).
In case of prepayment as the payment method, and if the payment is not made promptly, the Sales Agreement is considered concluded upon the Customer receiving the email: "Oops! Your Order has not yet been paid."
For Sales Agreements concluded by phone, confirmation will be provided on a durable medium no later than the delivery of the Products. All phone calls with the helpline are recorded for quality and security reasons.
Only properly placed Orders will be fulfilled. An Order is properly placed if all data required to conclude and fulfill the Sales Agreement is provided. The Order will not be fulfilled if:
- The Customer provides incorrect or false data, especially contact data preventing Order fulfillment;
- The Order is improperly placed, preventing its fulfillment;
- The Order violates the Terms and Conditions;
- There is a justified suspicion of fraud by the Customer, including actions such as bypassing Store security, using another person’s login/password, or impersonating another person.
The Seller reserves the right to cancel Orders placed in violation of §5(10) of the Terms and Conditions.
For multiple Products in one Order, delivery may occur in more than one shipment. The Customer does not bear additional shipping costs.
6. Prices
All Product prices include VAT at the applicable rate.
Promotions in the Store are not combinable unless the promotion’s regulations state otherwise.
Any price reduction notice indicates the previous price applied by the Seller in the same sales area for a defined period before applying the reduction. The previous price represents the lowest price used by the Seller in the same sales area within the last 30 days before applying the price reduction.
7. Delivery and Payment Methods
Delivery of Products is limited to the territory of the Republic of Poland.
The Seller delivers Products through methods specified on the Store’s website at www.snkrz.co and during the checkout process.
Some delivery methods may limit available payment methods. Permissible payment methods will be displayed to the Customer during checkout after selecting a delivery method. Generally, offered payment methods are:
- Prepayment before receiving Products – via electronic payment systems or other electronic payment methods specified on the Store’s website;
- Payment upon delivery to the Customer.
For prepayment, payment must be made immediately after placing the Order. Delivery costs are specified on the Store’s website and during checkout.
For electronic prepayments, the Order will be fulfilled after the Seller receives confirmation of payment from the payment system operator.
By accepting the Terms and Conditions, the Customer agrees to electronic invoicing. The Customer will receive invoices and corrections to the provided email.
Upon receiving the shipment, the Customer should check its condition. In case of damage, the Customer should prepare a damage report in the presence of the Courier and notify the Seller.
8. Right of Withdrawal
- Consumers have the right to withdraw from the Sales Agreement within 14 days without giving any reason, in accordance with the Consumer Rights Act.
- The withdrawal period starts from:
- the day the Customer or a third party indicated by the Customer (other than the carrier) receives the Product;
- To exercise the right of withdrawal, the Consumer must notify the Seller via:
- email: help@snkrz.co, or
- written statement sent to the Seller’s address.
- Upon withdrawal, the Consumer must return the Product to the Seller within 14 days from the notification. The Customer bears the cost of returning the Product.
- The Product must be returned undamaged, complete, and in original packaging.
Refunds are made within 14 days after the Seller receives the returned Product.
9. Complaints / Product Non-Conformity
- The Seller is responsible for any Product non-conformity with the contract for a period of two years from delivery, unless a longer statutory period applies.
- The Customer may claim:
- Repair or replacement;
- Price reduction;
- Withdrawal from the contract if repair or replacement is impossible, excessively costly, or not performed within a reasonable time.
- Complaints must be submitted via:
- the Store, or
- in writing to the Seller’s office.
- The Seller responds within 14 days of receiving the complaint.
- Consumers can also use the EU online dispute resolution platform: http://ec.europa.eu/consumers/odr.
10. Rules for Using Electronic Services
- Accessing the Store requires:
- Internet Explorer 8+, Mozilla Firefox 3+, Google Chrome 21+, or other modern browsers;
- JavaScript and cookies enabled.
- Customers may not:
- Provide unlawful or offensive content;
- Interfere with the operation of the Store;
- Send spam or unauthorized advertisements;
- Violate laws or these Terms.
- The Seller secures Customer data against unauthorized access.
- Complaints regarding technical operation of the Store are resolved within 14 days.
11. Customer Reviews
- Customers may submit Reviews only after purchasing a Product.
- The Seller collects: name, email, and order information necessary to verify authenticity.
- By submitting a Review, the Customer grants the Seller a free, non-exclusive, worldwide license to:
- Reproduce, store, and publicly display the Review;
- Adapt, modify, translate, and sublicense;
- Use without attribution or compensation.
- Reviews must not contain illegal, offensive, promotional, or copyrighted content.
- The Seller reserves the right to remove Reviews violating these rules.
- Optional rewards for Reviews (e.g., discount codes) are governed by separate rules.
12. Agreements with Non-Consumers
- Non-consumer Customers (businesses) are not covered by the Consumer Rights Act.
- Warranty claims and withdrawal rights under consumer law do not apply to non-consumer Customers.
- Sales Agreements with non-consumer Customers are governed by the Civil Code.
- Disputes with non-consumer Customers are resolved by the court having jurisdiction over the Seller’s registered office.
- The Seller may, at its discretion, offer additional voluntary rights or guarantees to non-consumer Customers, which must be confirmed in writing.
